SINGAPORE - A New York-based pharmaceutical company has lost its patent for a brand-name Viagra, prompting regulators to add the drug’s patent to a list of pharmaceutical products that have been approved by the United States Food and Drug Administration (FDA).
According to a press release, the drug maker has applied for approval to market generic Viagra or its equivalent, while the U. S. Food and Drug Administration (FDA) will allow the drug to be sold as a generic under the new trade name.
In addition, the company is awaiting the FDA’s final decision regarding its patent for the brand-name product.
The company’s patent for the drug is still pending in the United States but is likely to be reclassified by the FDA as a generic.
“Patents are granted only to the best of the public when the benefit to the individual is uncertain or the public is not informed of the possibility of a potential conflict of interest,” said John B. Lechleiter, the company’s president. “This is not a new development and, as such, is expected to be of little consequence for the company.”
The FDA has not ruled on the pending application, but it is expected to decide in late spring after the company’s presentation of the patent to the FDA.
The company said the company’s patent for the product has expired in Europe. It is now looking for a generic version of the drug and would have to sell the drug in the United States as well.

The company has submitted the application for approval to market generic versions of the drug.

The company said it has not received any comments from the company’s customers and the company is not currently selling the product.
“Patients who have not yet started taking this medication are advised that their treatment with Viagra® will continue to be monitored, and that they are not able to buy any new or any new medications without consulting their physician,” Lechleiter said.
The company is awaiting the FDA’s decision regarding the patent for its brand-name product and expects to receive approval in early spring.
